General Terms & Conditions
These General Terms and Conditions (GTC) apply to all orders placed with www.seedamm.shop by Elecsystrail AG. In the event of any discrepancies between these general terms and conditions and the general terms and conditions specific to online orders, the latter shall take precedence for online orders. Provisions deviating from these terms and conditions, in particular those in the general terms and conditions of the customer or agreements made verbally or by telephone, shall only apply if they have been expressly accepted by us in writing.
1. How to order
If you need advice, you can reach us by telephone Monday to Friday from 9.00-11:30 and 14:00-16:00. You can also place your order online. The contract language is German. An english store version is available.
2. Prices
All prices include the applicable value added tax.
3. Shipping costs / surcharges
For every order we charge a postage and packaging fee for orders up to CHF 100.00. The fee is CHF 12.50 for shipping with Swiss Post Economy / CHF 16.50 for shipping with DHL Swiss Pack. Shipping is free for orders from CHF 100.00 with Swiss Post Economy (DHL is optional available at additional charges). Each package is sent with a barcode and can be traced at the post office / DHL. If we deliver your order in several parts for technical reasons, we will of course only charge the shipping costs once.
For items that cannot be sent as a standard parcel due to their dimensions (bulky goods), the transport service providers charge a service surcharge, which we pass on.
4. Delivery
We deliver, as noted on the website between 5-10 working days for certain products we will also carry out your order in partial deliveries.
Please note, however, that Elecsystrail AG does not deliver goods abroad, only in Switzerland and Lichtenstein.
5. Warranties and defects
Our manufacturers guarantee the reliability of their products. Obvious defects, including transport damage, must be reported to us immediately, but at the latest within 14 days of receipt of the delivery. We will, at our discretion, rectify the defects free of charge or supply you with an equivalent replacement. If we are unable to rectify the defects or supply a replacement within a reasonable period of time, you are entitled to cancel the purchase. Please keep the goods at our disposal.
6. Liability
Claims for damages, irrespective of the legal grounds (claims for culpa in contrahendo, breach of secondary obligations, tort and other statutory claims), are excluded. We shall not be liable for damage that has not occurred to the delivery item itself; in particular, we shall not be liable for indirect damage, loss of profit or other financial losses of the customer. Furthermore, any compensation for delayed deliveries is excluded. The exclusion of liability shall not apply if damage has been caused by gross negligence or willful misconduct on our part. As our products are not mass-produced items, slight deviations from the product illustrations and specifications may occur, for which we are not liable. However, you can return such items - like all other items - within the 10-day period.
Elecsystrail AG accepts no liability, especially in the event of trademark infringement by producers and suppliers.
6.1 Liability and exclusion of liability
Liability is governed by the applicable statutory provisions. However, Elecsystrail AG is in no case liable for slight or severe negligence, indirect or consequential damages.
Furthermore, Elecsystrail AG rejects liability in the following cases:
-inappropriate, non-contractual or unlawful storage, adjustment or use of the products;
Use of incompatible spare parts or accessories (e.g. power supply);
-failure to maintain and/or improper modification or repair of the products by the customer or a third party;
force majeure, in particular damage caused by the elements, moisture, falling and impact, etc., for which Elecsystrail AG is not responsible, and official orders.
7. Right of return
If you do not like a delivered item, you can return it within 10 days of delivery - only unused, in perfect, saleable condition and in our original packaging (sale items, cut goods and all special and custom-made products are understandably excluded from this). The return shipment is at your own liability/risk. The costs of the return shipment are at your expense. Therefore, please stamp the package with sufficient postage. Any credit balance resulting from the return will be refunded immediately, unless you wish to use it for another order. Please note that we will only refund the purchase price of the product, not the shipping costs.

8. How you can pay
New customers: You pay in advance by Visa, MasterCard, Postfinance, Twint, ApplePay or GooglePay. All personal data is transmitted SSL-encrypted.
Registered customers (already ordered and paid once): You pay by Visa, MasterCard, Postfinance, Twint, ApplePay or GooglePay. All personal data is transmitted SSL-encrypted.
The goods will only be dispatched after full payment has been received via the systems.
9. Merchandise voucher
The merchandise vouchers (vouchers that you purchase) can be redeemed for the purchase of products offered at www.seedamm.shop. However, they cannot be used for the purchase of further vouchers. The issuing and redemption currencies must be identical.
The credit balance of a voucher is in CHF and does not bear interest. Cash redemption is not possible. The value of a voucher must be at least CHF 20.00 and no more than CHF 250.00 at the time of purchase.
Shipping costs CHF 2.40 for the voucher.
It is not possible to redeem the voucher after we have received the order or to offset it retrospectively.
The voucher cannot be combined with other promotions or vouchers.
If the credit balance on the voucher is not sufficient for the order, the difference can be settled using the payment options offered. Partial redemptions are possible, the remaining value remains on the voucher.
The voucher is transferable and valid for 1 year. Duplication, editing or manipulation of the vouchers is not permitted. We accept no liability for the loss, theft or illegibility of vouchers or for spelling mistakes in the e-mail address of the voucher recipient and cannot replace the voucher.
10. Retention of title
The delivered goods remain our property until full payment has been made.
11. Privacy policy
We store your address and order-related data in order to process your order. These can be used in the context of order processing, competition and newsletter. Your data will be treated confidentially and will not be passed on to third parties unless this is necessary for order processing (e.g. logistics service providers, credit checks).
12. Image rights
All image rights are held by Elecsystrail AG or its partners / suppliers. Use without express permission is not permitted.
13. Alcohol and tobacco products
SEEDAMM.SHOP does not sell alcohol or tobacco products to young people under the age of 18.
By ordering spirits and tobacco products, the customer undertakes to ensure that the delivery is accepted by a person of legal age.
14. Liability
14.1 GTC rules
These GTCs conclusively regulate all cases of breaches of contract and their legal consequences and all claims of the customer, regardless of the legal grounds on which they are made. The seller, its auxiliary persons and any vicarious agents shall not be liable for damages that have not occurred to the goods themselves, in particular not for consequential damages, other financial losses of the buyer or loss of profit.
14.2 Severability clause
Should individual provisions of these General Terms and Conditions be invalid or incomplete, this shall not affect the validity of the remaining provisions. The parties undertake to replace the invalid provisions with a legally valid provision that comes as close as possible to the economic and legal meaning and purpose of the invalid provision.
Swiss law shall apply exclusively. The place of jurisdiction is Altendorf.
